1. Who you are contracting with

These Terms govern your use of the Stifinwise website and the Learning & Teaching Studio digital software (the "Service"), provided by Raez Najya Trading ("Stifinwise", "we", "us", "our"), a business registered in Malaysia. By creating an account, subscribing, or otherwise using the Service you agree to these Terms.

2. Eligibility and account

You must be of legal age in your jurisdiction to enter into a binding contract, or have permission from a parent or guardian. If you sign up on behalf of an organisation, you confirm you have authority to bind that organisation. You are responsible for keeping your login credentials confidential and for all activity under your account, and you agree to provide accurate information and keep it up to date.

3. The Service

The Service is online software that helps users understand learning patterns and design teaching plans (Learn Your Way, Teach Their Way, Teaching Lab, Profile Library, Saved Plans, PDF export). It is an educational tool. It does not perform official STIFIn biometric testing and does not replace certified consultation, psychological diagnosis, medical advice, or formal school placement decisions.

4. Acceptable use

You agree not to misuse the Service. In particular you will not:

• use the Service unlawfully, fraudulently, or to send spam;
• infringe the intellectual property or privacy rights of others;
• upload malware, probe, scan, or interfere with the security or integrity of the Service;
• scrape, reverse engineer, resell, or redistribute the Service or its outputs except as permitted by these Terms;
• circumvent usage limits, access controls, or subscription tier restrictions.

5. Intellectual property

Raez Najya Trading retains all rights, title, and interest in the Service, including the software, content, branding, and documentation. Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable right to use the Service within the plan you have subscribed to. Plans, profiles, and notes you create remain yours; you grant us a limited licence to host and process that content solely to provide the Service.

6. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency, and renewal mechanics are governed by Paddle's Buyer Terms.

Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account or via paddle.net; cancellation takes effect at the end of the current paid period. Fees are stated on our pricing page and may change with notice before your next renewal.

7. Refunds

Refunds are handled under our Refund Policy and Paddle's refund process.

8. Service availability and warranties

We work to keep the Service available and accurate, but we do not guarantee that it will be uninterrupted, error-free, or that it will meet a specific outcome. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time by cancelling your subscription and closing your account. On termination you may export your saved plans and profiles for a reasonable period before deletion.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is not permitted by law.

11. Indemnity

You agree to indemnify Raez Najya Trading against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Malaysia. Disputes will be brought before the courts of Malaysia, without prejudice to any mandatory consumer rights you have in your country of residence.
